DMCA & Copyright Policy

1. Overview

Goji Solution Pvt. Ltd. complies with the Digital Millennium Copyright Act (17 U.S.C. § 512), the EU Copyright Directive (2019/790/EU), and equivalent laws in other jurisdictions. We have designated a Copyright Agent to receive notices of claimed copyright infringement.

While Goji Solution Pvt. Ltd. is incorporated in Nepal, we process DMCA-style requests as a best-practice standard regardless of the geographic origin of the complaint. We will investigate all credible notices promptly.

2. What This Policy Covers

This policy applies to all content hosted or displayed on goji.my, including:

• Editorial text and written reviews authored by our team
• User-submitted reviews and comments
• Images, screenshots, and media files uploaded to the Platform
• Tool descriptions and marketing copy
• Blog articles and guide content

Tool logos, brand assets, and product screenshots displayed on tool listing pages are used for identification and review purposes under fair use / fair dealing doctrines. Vendors who wish to update their brand assets should use our vendor portal.

3. How to File a Takedown Notice

To notify us of alleged copyright infringement, your notice must include all of the following (a deficient notice will not be acted upon):

• Your contact information: full legal name, mailing address, telephone number, and email address
• Identification of the copyrighted work you claim has been infringed (if multiple, a representative list)
• Identification of the allegedly infringing material with sufficient specificity for us to locate it (exact URL preferred)
• A statement that you have a good faith belief that the disputed use is not authorised by the copyright owner, its agent, or the law
• A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorised to act on their behalf
• Your physical or electronic signature

4. Our Response Process

Upon receiving a complete and valid notice:

• We will acknowledge receipt within 2 business days
• We will investigate and, if appropriate, remove or disable access to the allegedly infringing material promptly
• We will notify the user who uploaded the content (if applicable) of the takedown
• We will forward the notice to the affected user to allow them to file a counter-notice
• Removed content will be replaced by a notification explaining it has been removed due to a copyright claim

5. Counter-Notice Procedure

If you believe your content was removed in error or misidentification, you may submit a counter-notice including:

• Your contact information (name, address, telephone, email)
• Identification of the removed material and its location before removal
• A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
• Your consent to the jurisdiction of the courts of Kathmandu, Nepal (or, for US-based individuals, your local federal district court)
• Your physical or electronic signature

Send counter-notices to [email protected] with subject “DMCA Counter-Notice.” Upon receipt of a valid counter-notice we will forward it to the original claimant. If the claimant does not file a court action within 10–14 business days, we may restore the removed content.

6. Repeat Infringer Policy

Goji Solution Pvt. Ltd. maintains a policy of terminating accounts of users who are found to be repeat infringers of intellectual property rights in appropriate circumstances, as required by the DMCA safe harbour provisions.

7. Fair Use and Tool Branding

goji.my displays tool logos, product screenshots, and brand names for the purpose of identification, review, and commentary. Such use constitutes nominative fair use under US law and equivalent doctrines in other jurisdictions.
